Public Interest Test

Where exemptions are not absolute exemptions they are subject to a public interest test. This test requires a public authority to determine whether the public interest in withholding the exempt information outweighs the public interest in releasing it.

The Freedom of Information Act does not define 'the public interest'. Roads Service must therefore consider the circumstances of each particular case and the exemption that covers the information.
