What is a Statutory Declaration?

When Roads Service serves a Charge Certificate it must explain that the liable person (the registered keeper) may serve a Statutory Declaration on an adjudicator before the end of the period of 21 days from the date of the Charge Certificate on one of the following grounds:

  • (a) that the appellant did not receive a Notice to Owner;
  • (b) that the appellant made representations to Roads Service but did not receive a Notice of Rejection; or
  • (c) that the appellant appealed to an adjudicator but did not receive a notice of his decision.
If a Statutory Declaration is served it will be dealt with by an adjudicator.
